En este trabajo se defiende la tesis de que el liberalismo de corte individualista ha sido insuficiente como modelo teórico político para realizar el ideal liberal de libertad individual y, sobre esa base, se argumenta que lo determinante a la hora de realizar el ideal de libertad individual es la relación entre cultura y libertad. El liberalismo, sin que por ello ignore que hay culturas, se enfoca decididamente en el individuo y en su libertad. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. The article aimed to determine the relationship between neuroscience and emotional states in university faculty members from Latin America during the post-pandemic stage of COVID-19. It highlights the importance of understanding emotions from a neuroscientific perspective to develop strategies that enhance emotional management and resilience in the educational context. The descriptive-correlational research included a sample of 318 faculty members from various Latin American countries. The results revealed severe levels of stress (88.4%) and anxiety (92.1%), as well as inadequate (40.9%) or (...) moderate (46.9%) levels of resilience among the faculty members. A strong positive correlation was found between neuroscience and emotional states (rho=0.860), as well as a good positive correlation between neuroscience and resilience (rho=0.739). The study concludes that the knowledge and application of neuroscience principles could contribute to lower levels of stress and anxiety and increase resilience in university faculty members, emphasizing the importance of integrating these disciplines into the understanding and management of emotions in the educational field. Objective: Loneliness is the subjective distress of feeling alone and has a strong impact on wellbeing and health. In addition to well-known predictors like isolation and poor health, a better understanding of the psychological determinants of loneliness would offer effective targets for future complementary interventions.Methods: In this cross-sectional observational study, we compared the explanatory power of several important risk factors of loneliness with the affective, motivational, and cognitive aspects of the Meaning in Life construct. Different nested linear models were compared (...) including socio-demographic, lifestyles, social-connectedness, and self-rated health variables, to assess the overlapping and non-overlapping explanatory power of each of them.Results: Health status and MiL were found to be the most important predictors of loneliness, followed by social connectedness and, with a much lower weight, lifestyles, and socio-demographic factors. Within the MiL factor, the most cognitive component, sense of coherence, had a greater explanatory power than the more affective and motivational ones.Conclusion: Reduced MiL, the capacity of an individual to attach “value and significance” to life, is a crucial predictor to the feeling of loneliness. These results suggest that programs aiming to combat loneliness should go well beyond situational interventions and include more cognitive, value-centered interventions that enable individuals to define and pursue a meaningful vital plan. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. Given the pervasiveness of AI systems and their potential negative effects on people’s lives (especially among already marginalised groups), it becomes imperative to comprehend what goes on when an AI system generates a result, and based on what reasons, it is achieved. There are consistent technical efforts for making systems more “explainable” by reducing their opaqueness and increasing their interpretability and explainability. In this paper, we explore an alternative non-technical approach towards explainability that complement existing ones. Leaving aside technical, statistical, (...) or data-related issues, we focus on the very conceptual underpinnings of the design decisions made by developers and other stakeholders during the lifecycle of a machine learning project. For instance, the design and development of an app to track snoring to detect possible health risks presuppose some picture or another of “health”, which is a key notion that conceptually underpins the project. We take it as a premise that these key concepts are necessarily present during design and development, albeit perhaps tacitly. We argue that by providing “justificatory explanations” about how the team understands the relevant key concepts behind its design decisions, interested parties could gain valuable insights and make better sense of the workings and outcomes of systems. Using the concept of “health”, we illustrate how a particular understanding of it might influence decisions during the design and development stages of a machine learning project, and how making this explicit by incorporating it into ex-post explanations might increase the explanatory and justificatory power of these explanations. We posit that a greater conceptual awareness of the key concepts that underpin design and development decisions may be beneficial to any attempt to develop explainability methods. We recommend that “justificatory explanations” are provided as technical documentation. These are declarative statements that contain at its simplest: (1) a high-level account of the understanding of the relevant key concepts a team possess related to a project’s main domain, (2) how these understandings drive decision-making during the life-cycle stages, and (3) it gives reasons (which could be implicit in the account) that the person or persons doing the explanation consider to have plausible justificatory power for the decisions that were made during the project. Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). A sustainable supply chain management strategy reduces risks and meets environmental, economic and social objectives by integrating environmental and financial practices. In an ever-changing environment, supply chains have become vulnerable at many levels. In a global supply chain, carefully tracing a product is of great importance to avoid future problems. This paper describes a self-updating smart contract, which includes data validation, for tracing global supply chains using blockchains. Our proposal uses a machine learning model to detect anomalies on traceable data, (...) which helps supply chain operators detect anomalous behavior at any point in the chain in real time. Hyperledger Caliper has been used to evaluate our proposal, and obtained a combined average throughput of 184 transactions per second and an average latency of 0.41 seconds, ensuring that our proposal does not negatively impact supply chain processes while improving supply chain management through data anomaly detection. The nonlinear differential equation governing the periodic motion of the one-dimensional, undamped, and unforced cubic-quintic Duffing oscillator is solved exactly by obtaining the period and the solution. The period is given in terms of the complete elliptic integral of the first kind and the solution involves Jacobian elliptic functions. We solve the cubic-quintic Duffing equation under arbitrary initial conditions. Physical applications are provided. The solution to the mixed parity Duffing oscillator is also formally derived. To analyze which ethically relevant biases have been identified by academic literature in artificial intelligence algorithms developed either for patient risk prediction and triage, or for contact tracing to deal with the COVID-19 pandemic. Additionally, to specifically investigate whether the role of social determinants of health have been considered in these AI developments or not. We conducted a scoping review of the literature, which covered publications from March 2020 to April 2021. ​Studies mentioning biases on AI algorithms developed for contact (...) tracing and medical triage or risk prediction regarding COVID-19 were included. From 1054 identified articles, 20 studies were finally included. We propose a typology of biases identified in the literature based on bias, limitations and other ethical issues in both areas of analysis. Results on health disparities and SDOH were classified into five categories: racial disparities, biased data, socio-economic disparities, unequal accessibility and workforce, and information communication. SDOH needs to be considered in the clinical context, where they still seem underestimated. Epidemiological conditions depend on geographic location, so the use of local data in studies to develop international solutions may increase some biases. Gender bias was not specifically addressed in the articles included. The main biases are related to data collection and management. Ethical problems related to privacy, consent, and lack of regulation have been identified in contact tracing while some bias-related health inequalities have been highlighted. There is a need for further research focusing on SDOH and these specific AI apps. (shrink)

The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. Este estudio buscó describir e interpretar las teorías subjetivas sobre la identidad profesional docente que se construyen y difunden noticiosamente durante la educación de emergencia por la pandemia de COVID 19. Se utilizó un estudio de análisis documental, metodología cualitativa y un diseño de estudio de casos. El muestreo intencionado y por conveniencia corresponde a 40 noticias de prensa escrita en español, sobre el profesor(a) en pandemia y publicadas en diferentes medios que fueron recolectadas a través de Google Noticias desde (...) el 11 de marzo de 2020 y hasta el 01 de noviembre de 2020. A partir de una codificación temática, los resultados evidenciaron teorías subjetivas asociadas a las exigentes características, roles, funciones y valores con los que se identifica al profesorado durante la pandemia. El análisis mostró los distintos sentidos del ejercicio profesional y las competencias asociadas a su desempeño en la prensa. Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. Virtue ethics is not opposed to principle-based ethics, but rather complements its task and develops it more fully. In the field of US bioethics, this option has proved to be even more fruitful, especially in the work of Edmund Pellegrino and David Thomasma. Virtue ethics is also being reappraised in relation to the ethics of organisations and (...) business. It is considered that the best way of running a company does not depend solely on a group of ethical principles or agreed criteria, but on the effective exercise of certain qualities of character. Indeed, minimal ethics do not guarantee the excellence of organisations, or even their correct development. They guarantee certain standards of coexistence, but this is not sufficient to carry forward a collective enterprise in a creative way. It is impossible to achieve the aims of an organisation without ambition, magnanimity, humility, prudence, responsibility and courage. This group of intangible elements are virtues. This article explores the process of decision-making in the light of Aristotelian ethics, in particular his work _Nicomachean Ethics_. Making decisions is a common task on the managerial agenda. The decisions of a manager affect individuals, the future of the organisation and, of course, they have consequences for the organisation and its surroundings. Aristotle dedicates Book III of the work in question to studying the art of deliberation and examining which virtues must be taken into account when reaching the best decision. Aristotle tells us that we deliberate about things that are within our power and can be done. There can be no deliberation upon exact and sufficient knowledge; however, we deliberate upon the things that are brought about by our own efforts, although not always in the same way. Leading an organisation is not a mechanical matter, but rather a process that requires creativity and responsibility. There are many different ways of doing it. Following the Aristotelian doctrine, this article aims to examine the elements that must be taken into consideration for correct decisions to be made. The following virtues play a fundamental role in this process: prudence, fortitude, justice and temperance, referred to below as called cardinal virtues. (shrink)

In 2016, Béziau introduces a restricted notion of paraconsistency, the so-called genuine paraconsistency. A logic is genuine paraconsistent if it rejects the laws $\varphi,\neg \varphi \vdash \psi$ and $\vdash \neg (\varphi \wedge \neg \varphi)$. In that paper, the author analyzes, among the three-valued logics, which of them satisfy this property. If we consider multiple-conclusion consequence relations, the dual properties of those above-mentioned are $\vdash \varphi, \neg \varphi$ and $\neg (\varphi \vee \neg \varphi) \vdash$. We call genuine paracomplete logics those rejecting (...) the mentioned properties. We present here an analysis of the three-valued genuine paracomplete logics. A very natural twist structures semantics for these logics is also found in a systematic way. This semantics produces automatically a simple and elegant Hilbert-style characterization for all these logics. Finally, we introduce the logic LGP which is genuine paracomplete is not genuine paraconsistent, not even paraconsistent and cannot be characterized by a single finite logical matrix. (shrink)

Un mundo en el que las mujeres salen de su silencio para tomar la palabra y dejar oír sus pensamientos y manifestar su propia interpretación del mundo.

Los medios de comunicación incrementan la cobertura de hallazgos sobre el pasado. Impedir la discriminación por razón de sexo es mandato de los códigos deontológicos periodísticos. Desde la perspectiva de género, el estudio abordó la presencia de científicas como sujetos noticiables y fuentes expertas. Se analizaron mediante técnicas cuantitativas y cualitativas mensajes (n=59) en los dos principales diarios españoles de referencia (El País, El Mundo). Es preponderante la voz del profesional de la arqueología y prima la autoría de reporteros especializados. (...) En los estudios de Marx sobre el modo de producción específicamente capitalista en la periferia, más allá de Europa occidental, encontramos un doble movimiento: sus estudios históricos configuran todo un campo de tensiones en el que podemos examinar sus posiciones políticas y teóricas entrecruzadas con los cambios y las contradicciones históricas del siglo xix. Analizando las opiniones de Marx sobre la cuestión colonial y la cuestión nacional en casos tan variados como los de India, América Latina, China, Irlanda, Polonia o (...) Rusia comprobamos su distanciamiento creciente pero irregular con respecto al “sistema” hegeliano, que nunca dejó de inspirarlo, en un intento de superar la teleología de la historia. En cuestionamiento se encontraba el presupuesto de que las formas sociales superiores surgen del agotamiento y la aniquilación de las directamente inferiores. Aunque imperfecta, la superación de la teleología acercó a Marx al reconocimiento de la coexistencia en el espacio y en el tiempo de formas sociales heterogéneas, lo que apuntaba hacia una concepción diferente de la teoría y la acción política. El proyecto educativo Auschwitz: El escenario del horror se desarrolla entre 2017 y 2019, desde su gestación hasta las exposiciones de fotografías y charlas-coloquio en el que se ha enmarcado. Forma parte de una enseñanza informal, en el que los aprendizajes están determinados por situaciones cotidianas del contacto social, que no está organizado o administrado por una estrategia educativa determinada. Es una experiencia que se desarrolla en ámbitos relajados, como en el caso de asociaciones culturales o ayuntamientos. El autor de (...) las fotografías desempeña el símbolo de la mirada del visitante, que, a través de su cámara, nos enseña el campo de muerte de Auschwitz, describiéndonos los sentimientos y las sensaciones que allí pudieron acontecer en los primeros años de la década de los 40. In recent writings Paul Horwich has pursued two related aims: (i) To show “how small a constraint is provided by compositionality” (Horwich 1998, chapter 7, p. 183). “The compositionality of meaning imposes no constraint at all on how the meaning properties of words are constituted” (p. 154). Alasdair MacIntyre asks, if all individuals are in fact potential authorities of natural law and agree on its fundamentals, how can we explain manifest moral disagreement? Contemporary Thomistic natural law theorists have not attempted to address this particular issue to a significant degree. MacIntyre, taking this large-scale rejection seriously, focuses on the communal factors that allow individuals to recognize their need for and commitment to Thomistic natural law. By doing so, he attempts to give reasons for why we should expect (...) natural law to be widely denied in contemporary society. In this paper, I argue that MacIntyre’s approach to natural law is capable of accounting for the seemingly paradoxical claim that these per se nota first principles of natural law might suffer apparent widespread rejection. Moreover, I will argue that MacIntyre’s account is also capable of explaining why we should actually expect such rejection to occur. (shrink)

ObjectiveThe literature has shown the relevance of certain psychological variables in adjustment to cancer. However, there is a great variability, and these features could be modified through the disease process. The aim of this study is to provide an integrated and global perspective of the importance of variables such as coping, resilience, emotional control, social support, affect, and others in cancer patients through a longitudinal study, with the objective of exploring their associations and underlying interactions.MethodsThe sample was composed of 71 (...) people diagnosed with cancer who were attending psychological support at the Spanish Association Against Cancer. We assessed the following variables in two periods of 6 months: perceived stress, emotional control, resilience, coping strategies, personality, social support, affect, emotional distress, quality of life and visual-analogic scales.ResultsResults showed predictive effects of perceived stress on physical health perception. Mental health perception was influenced by almost all the psychological variables. Consciousness at baseline, change in Extraversion and Resilience had significant effects on perceived mental health.ConclusionThis study provides a global health model that integrates and explores associations between psychological variables related to cancer disease. This information could be useful for guiding personalized psychotherapeutic interventions, with the aim of increasing adjustment to disease. (shrink)
